Litigating Building Safety: Have we got it right?
In this talk, Mr Justice Waksman, Judge in Charge of the Technology and Construction Court, will look at how BSA claims and applications have been dealt with in the Courts and in the First Tier Tribunal. This will include consideration of applications for Remediation and Remediation Contribution Orders in the FTT and for Building Liability and Information Orders in the TCC, and how claims made in both will be managed efficiently and where they should be heard. He will also speak about recent trends in substantive BSA-related litigation, especially multi-party cladding cases, and how they are case-managed with a particular emphasis on expert evidence and the use of AI. He will also look at the recent decision of the Supreme Court in URS. There were be time for questions to the Judge on all of this and on any other BSA-related topic. So this should be of interest to all those involved in the construction industry and construction disputes.
